Mawogola North Parliamentary candidate Godfrey Aine Kaguta also known as Sodo has dragged the ruling National Resistance Movement (NRM Party) to court seeking to overturn its decision to deny him the party flag.
In the case filed on November 25th at the Kampala High Court’s Civil Division, Sodo, who is President Yoweri Museveni’s younger brother asked the court to cancel the decision of the NRM Tribunal which led to him being denied the NRM flag for Mawogola North.
The NRM Tribunal that was set up in the wake of the murky party primaries in September, decided to defer Sodo’s victory citing a number of irregularities.
This followed a petition to the tribunal filed by Sodo’s contender Ms Shartsi K. Musherure
Musherure told the Tribunal that the Mawogola primaries were marred with voter intimidation, violence and ferrying of illegal voters.
The NRM Tribunal recommended the matter to the Central Executive Committee (CEC) of the NRM which subsequently withdrew the NRM flag from Mr. Aine.
Currently, Mawogola North Constituency does not have an NRM flag bearer and both Musherure and Sodo have been nominated by the Electoral Commission as independents.
Meanwhile, Ms Musherure has since applied to the same High Court seeking to be enjoined to the suit that Sodo filed.
Shartsi filed the application yesterday asking to be added to the case on the defendants (NRM)’s side.
She said she needed to be heard on this matter and not to be excluded from the Court proceedings because the outcome of the Court’s decision could affect her candidature.
However, Mr. Aine’s lawyers opposed Shartsi’s application saying they were not ready to proceed with the hearing.
The judge asked the lawyers of both parties to share with Court their submissions in writing in order for him to give his judgment on the matter on 7th December 2020.
